If you have questions about these terms, contact us at official.hartlab@gmail.com .
1.1. Introduction
Welcome to HartLab Studios (“HartLab”, “we”, “our”, “us”). These Terms of Service (“Terms”) form a legally binding agreement between you (“User”, “you”) and HartLab regarding your access to and use of our websites, widgets, SaaS applications, APIs, scripts, embeds, integrations and any related services (“Services”), including those available on hartlab.vercel.app and associated domains.
By accessing, purchasing, subscribing to, installing, embedding, sharing or otherwise using any of our Services, you acknowledge that you have read, understood and agree to be bound by these Terms. If you do not agree, you must discontinue all use of HartLab Services immediately.
You also acknowledge and agree that the performance of our Services may depend on third-party platforms, including but not limited to Spotify, Google, hosting providers and authentication systems. HartLab is not responsible for interruptions, limitations or changes originating from these external platforms.
We may update, modify or replace these Terms at any time, and continued use of the Services after changes are posted constitutes acceptance of the updated Terms. If material changes are made, we will indicate the “Last Updated” date at the top of this page.
These Terms supersede any prior agreements, communications or representations related to the use of HartLab Services, whether written or oral.
1.2. Eligibility
To use HartLab Services, you must be at least 18 years old and have the legal capacity to enter into a binding agreement. By using the Services, you represent and warrant that you meet these requirements.
You agree that you will not use the Services for any unlawful, abusive, harmful, fraudulent or unauthorized purpose. This includes, but is not limited to:
- creating accounts using false information or on behalf of someone else;
- creating multiple accounts to bypass limits, trials or usage restrictions;
- attempting to access accounts or data that do not belong to you;
- reverse engineering, modifying, copying or reselling HartLab Services or code;
- automating requests, scraping, or otherwise abusing API limits;
- interfering with or disrupting the integrity or performance of the Services;
- using the Services in regions where such use would be illegal or restricted;
- using the Services to violate the terms of any third-party platform (e.g., Spotify).
You are fully responsible for all activity that occurs under your account and agree to maintain the security of your login credentials. HartLab reserves the right to suspend or terminate accounts that violate these Terms at our sole discretion.
1.3. Description of Services
HartLab Studios provides digital tools and software-as-a-service (“Services”), which may include, but are not limited to:
- customizable and embeddable widgets, components and visual elements;
- live data displays, analytics tools and micro-SaaS utilities for creators and businesses;
- dashboards, themes, templates, layouts and dynamically generated shareable pages;
- APIs, authentication flows and integrations that connect with external data providers.
The specific features, limitations and requirements of each product are described in the corresponding documentation, which forms an integral part of these Terms. HartLab may update, modify, add or remove features at any time to improve performance, security, compatibility or user experience.
Some Services may display, process or interact with content provided by users or external platforms. HartLab is not responsible for the accuracy, legality, availability or continued accessibility of any external data or content.
Unless explicitly stated otherwise, HartLab does not provide personalized development, custom code implementations or guaranteed uptime, and is not liable for interruptions caused by external APIs, authentication systems, user accounts, third-party infrastructure or network conditions.
1.4. Accounts & Authentication
Some HartLab Services require the creation of an account using supported authentication methods. By creating an account, you agree to provide accurate information and to keep your login credentials, session data and authentication tokens secure at all times.
- you are solely responsible for all activity that occurs under your account;
- you must not share, sell, rent or transfer your account or access credentials to others;
- you must not attempt to circumvent authentication systems or create multiple accounts to bypass usage limits, trials or restrictions;
- you must immediately notify us if you suspect unauthorized access or account compromise;
- you acknowledge that external authentication providers may affect access to the Services, and HartLab is not responsible for interruptions originating from third-party systems.
We may suspend, restrict or terminate accounts that appear compromised, misused or in violation of these Terms, including in cases of automated access, abuse, fraud, security risks or attempts to interfere with the integrity of the Services.
HartLab may also take any steps necessary to protect its platform, including temporary disabling login, revoking tokens, enforcing rate limits or requiring reauthentication to maintain security and compliance.
1.5. Subscriptions, Billing & Renewal
HartLab uses Paddle as its Merchant of Record to process payments, calculate and remit taxes, manage subscriptions and issue invoices. By purchasing a product or subscription, you agree to comply with Paddle’s Terms and Buyer Policies, which operate in addition to these Terms.
By completing a purchase, you acknowledge and agree that:
- your subscription may automatically renew at the end of each billing cycle unless you cancel before renewal;
- renewal charges will be processed using the payment method associated with your Paddle account;
- prices, billing intervals and plan features may change, with notice provided where required by applicable law;
- applicable taxes, VAT, GST or regional fees may be added to the total amount charged;
- all payment details are processed exclusively by Paddle; HartLab does not store, access or handle your payment data.
It is your responsibility to manage, modify or cancel your subscription. Failure to cancel before the renewal date will result in automatic billing for the next period.
You are responsible for ensuring that your payment method remains valid, updated and able to process recurring charges. Failed payments may result in immediate suspension or limited access to the Services until the issue is resolved.
HartLab is not responsible for delays, errors or interruptions in billing caused by payment processors, banks, card issuers, currency conversion, regional tax rules or third-party financial institutions.
Any refunds are subject to Paddle’s refund policies and applicable law. HartLab does not issue direct refunds and cannot override decisions made by Paddle.
1.6. Cancellation
You may cancel your subscription at any time through the Paddle customer portal or, where available, through your HartLab account dashboard. Cancellation requests made by email, social media or any method other than the official cancellation flow are not valid and will not be processed.
Upon cancellation, your subscription will remain active until the end of the current paid billing period. No refunds or prorated credits are issued for unused time, and cancellation does not entitle you to any reimbursement beyond Paddle’s applicable refund window.
You are solely responsible for managing and canceling your subscription before the renewal date. Failure to cancel before renewal will result in automatic billing for the next period, in accordance with Section 1.5 (Subscriptions, Billing & Renewal).
If your payment method fails, expires or cannot be charged, access to the Services may be limited or suspended until the payment issue is resolved. Such interruptions do not constitute a cancellation.
Cancellation of your subscription does not automatically delete your account or data. Account deletion requests, when available, must be submitted separately and do not affect billing that has already occurred.
HartLab is not responsible for delays or issues with cancellation caused by Paddle, payment processors, banks, card issuers or third-party platforms.
1.7. Acceptable Use
You agree to use the Services only for lawful purposes and in compliance with these Terms. You must not engage in any activity that could harm HartLab, other users or any third party.
Prohibited activities include, but are not limited to:
- violating any applicable law, regulation or third-party platform policy;
- sending spam, abusive messages, harassment or unauthorized promotional content;
- attempting to access, probe or interfere with systems, accounts or data not belonging to you;
- reverse engineering, decoding, decompiling, modifying or attempting to bypass security measures;
- using automated tools, bots or scripts to access or overload the Services;
- creating multiple accounts to bypass limitations, trials or usage restrictions;
- misusing or redistributing any HartLab code, widgets, assets or intellectual property;
- removing, altering or obscuring HartLab branding, attributions or required notices where applicable;
- scraping, extracting or mass-collecting data from the Services without permission;
- using the Services for fraudulent, deceptive or harmful activities;
- attempting to impersonate HartLab or represent an affiliation you do not possess.
HartLab reserves the right to monitor usage, investigate violations and suspend, restrict or terminate access to the Services at its sole discretion if any activity violates these Terms or poses a security, legal or operational risk.
1.8. Intellectual Property
All HartLab Studios (“HartLab”) software, code, widgets, components, designs, animations, user interfaces, layouts, branding elements, trademarks, documentation, text, graphics and all other content made available through the Services are the exclusive property of HartLab or its licensors. They are protected by international copyright, trademark and intellectual property laws.
Except where explicitly permitted in writing, you may not copy, reproduce, modify, adapt, translate, create derivative works from, distribute, sell, sublicense, publicly display, publicly perform or otherwise exploit any part of the Services or underlying materials.
You are granted a limited, revocable, non-exclusive, non-transferable license to access and use the Services solely for their intended purpose and in accordance with these Terms. This license does not grant you any ownership or intellectual property rights, nor does it allow you to use HartLab assets for purposes outside the intended scope.
All rights not expressly granted to you are reserved by HartLab. Unauthorized use of HartLab’s intellectual property may result in suspension of access and may constitute a violation of applicable intellectual property laws.
You must not remove, alter or obscure any copyright notices, branding, attributions, watermarks, license identifiers or other proprietary markings included within the Services.
HartLab retains the right to enforce its intellectual property rights to the fullest extent permitted by law, including seeking legal remedies for unauthorized distribution, copying, repackaging, white-labeling, reverse engineering or resale of its assets.
1.9. Third-Party Services
Some HartLab features interact with or depend on external platforms, authentication providers, data sources, APIs or third-party services. These external services operate independently from HartLab, and we have no control over their performance, policies, stability, availability, limitations or technical changes.
Third-party outages, policy modifications, rate limits, regional restrictions, revoked tokens, authentication failures, API changes or discontinued features may affect your ability to use certain HartLab functionalities. Such disruptions do not constitute a breach of these Terms and do not entitle you to refunds or compensation.
You agree that it is your responsibility to comply with any applicable terms of the third-party platforms you choose to connect to the Services. HartLab is not responsible for actions taken by external services against your accounts, data or usage.
HartLab may modify, limit or discontinue integrations with third-party services at any time if necessary for compliance, security, technical compatibility or operational reasons.
1.10. Limitation of Liability
To the fullest extent permitted by applicable law, HartLab Studios (“HartLab”) shall not be liable for any indirect, incidental, special, exemplary, punitive or consequential damages, including but not limited to loss of profits, revenue, business opportunities, goodwill, data loss, service interruption or system failures, even if we have been advised of the possibility of such damages.
HartLab is not responsible for any issues arising from external platforms, authentication providers, data sources, APIs, third-party outages, rate limits, revoked access tokens, regional restrictions, infrastructure failures or changes beyond our reasonable control.
HartLab’s total aggregate liability for any claim related to the Services shall not exceed the amount you paid, if any, for the Services during the thirty (30) days immediately prior to the event giving rise to the claim. If you have not made any payments, your sole remedy is to discontinue use of the Services.
You acknowledge that the Services may experience interruptions, delays, errors, data inconsistencies or other limitations inherent to software and third-party dependencies. Such conditions do not constitute a breach of these Terms.
All Services are provided on an “as is” and “as available” basis, without any warranties or guarantees of any kind, whether express or implied.
1.11. Disclaimer of Warranties
The Services are provided on an “as is” and “as available” basis. HartLab makes no warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, uptime, reliability, or compatibility with any specific device, browser, region or third-party platform.
HartLab does not guarantee uninterrupted, error-free or secure operation of the Services, nor does it guarantee that third-party data, authentication systems or external providers will remain stable, available or unchanged.
You use the Services at your own risk.
1.12. Indemnification
You agree to indemnify, defend and hold harmless HartLab Studios, its owner, affiliates, contractors and partners from any claims, damages, losses, liabilities, costs or expenses (including reasonable legal fees) arising out of or related to:
- your use or misuse of the Services;
- your violation of these Terms or any applicable law;
- your content or data displayed through the Services;
- any dispute between you and a third party;
- your actions that cause harm to HartLab, other users or third parties.
HartLab reserves the right to assume exclusive defense and control of any matter subject to indemnification, in which case you agree to cooperate fully.
1.11. Changes to These Terms
HartLab Studios (“HartLab”) may update, modify or replace these Terms at any time to reflect changes in the Services, technical requirements, legal obligations, business operations or third-party policies. Any changes will be indicated by the “Last updated” date at the top of this page.
HartLab may, at its discretion, provide additional notice of material changes, including by email, in-product notifications or announcements within the Services. However, it is your responsibility to review the Terms periodically.
Continued access or use of the Services after updated Terms become effective constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must discontinue use of the Services.
HartLab is not responsible for any loss, limitation or impact on your use of the Services resulting from changes required for security, compliance, technical compatibility or third-party integration updates.
2. Privacy Policy
2.1. Data We Collect
We collect only the minimum data necessary to operate, secure and improve the Services. The categories of data we collect include:
- Account data: information you provide when authenticating with Google or another supported provider, such as your name, email address and basic profile information.
- Usage data: technical information such as device type, browser, operating system, IP address (for security and regional detection), approximate location (country or region), performance metrics and interaction logs. This data helps us maintain security, detect abuse and improve product functionality.
- Integration data: when you connect HartLab to an external service, we may process identifiers and authorization tokens associated with that connection. These tokens are used only to provide the linked functionality and may be revoked by you at any time.
HartLab does not collect or store: passwords, credit card numbers, bank information, sensitive personal categories (such as health, biometric, racial, political or religious data), or any information beyond what is strictly necessary to operate the Services.
Payment information is handled exclusively by Paddle, our Merchant of Record. HartLab never has access to your full payment details.
2.2. How We Use Your Data
We use the data we collect only for purposes that are necessary to operate, secure and improve the Services. Specifically, your data is used to:
- authenticate your account and maintain secure access sessions;
- deliver, configure and personalize widgets, dashboards and connected functionalities;
- provide customer support, respond to inquiries and resolve technical issues;
- monitor system performance, detect abuse, troubleshoot problems and improve reliability;
- analyze anonymized or aggregated usage patterns to enhance product functionality;
- comply with legal obligations, regulatory requirements and platform policies;
- prevent fraud, unauthorized access, harmful activity or violations of these Terms.
HartLab does not sell, rent or trade your personal data to third parties for marketing or commercial gain.
2.3. Legal Bases (GDPR / LGPD / CCPA)
Where applicable, HartLab processes personal data under recognized legal bases defined by international privacy laws. These include:
- Consent – when you authenticate with a provider, connect integrations or opt in to specific features.
- Contractual necessity – to deliver, maintain and provide access to the Services you requested when creating an account or subscribing.
- Legitimate interest – to secure our systems, prevent abuse, perform analytics, improve product performance and maintain reliable operation, provided these actions do not override your rights.
- Legal obligation – when processing is required to comply with tax rules, fraud prevention, regional regulations or requests from authorized governmental authorities.
2.4. Cookies & Local Storage
HartLab uses cookies and similar browser technologies (such as local storage) only for essential and security-focused purposes. These technologies help ensure the proper functioning of the Services.
We use these technologies for:
- session management, authentication and maintaining your logged-in state;
- protecting accounts, preventing abuse and enhancing security;
- storing user preferences or configuration settings when necessary;
- basic analytics to understand feature performance and improve reliability.
HartLab does not use advertising cookies, cross-site tracking technologies, fingerprinting scripts or any invasive third-party tracking tools.
You may manage or block cookies through your browser settings; however, disabling essential cookies may affect the ability to log in or use certain features of the Services.
2.5. Data Retention & Deletion
We retain personal data only for as long as necessary to operate the Services, maintain security, fulfill contractual obligations or comply with legal, regulatory or tax requirements. Retention periods may vary depending on the nature of the data and the purposes for which it was collected.
You may request deletion of your account and associated personal data at any time by contacting us at official.hartlab@gmail.com . We may require verification to confirm your identity before processing such requests.
When an account is deleted, HartLab will remove or irreversibly anonymize personal data associated with that account and revoke any authorization tokens used to connect external integrations. Certain information may be retained for a limited period in secure backups for fraud prevention, dispute resolution or compliance with legal obligations.
Deleting your account does not cancel active subscriptions or reverse charges already processed by Paddle. Subscription management must be performed through the Paddle customer portal, as described in Section 1.6.
2.6. Data Sharing
HartLab does not sell or trade personal data. We only share information with trusted third-party providers when it is strictly necessary to operate, secure or support the Services. These providers include:
- Payment and subscription processors (such as Paddle), which handle billing, tax calculation and subscription management.
- Hosting, infrastructure and security providers (such as cloud platforms, CDNs and monitoring tools) used to deliver reliable and secure service performance.
- External services you explicitly choose to connect, where we may share identifiers or authorization tokens required to enable those integrations. These connections are optional and can be revoked at any time.
All third-party providers are required to handle data in accordance with applicable privacy laws and maintain appropriate contractual, technical and organizational safeguards.
We do not permit third parties to use your data for advertising, profiling, cross-site tracking or marketing unrelated to the provision of the Services.
2.7. Security
HartLab implements technical, organizational and administrative safeguards designed to protect personal data against unauthorized access, loss, misuse, alteration or disclosure. These measures include:
- HTTPS encryption for all data transmitted between your device and our servers;
- restricted access to systems, logs and administrative tools on a need-to-know basis;
- secure handling and storage of authorization tokens and session identifiers;
- monitoring of infrastructure for unusual activity, abuse or security threats;
- avoidance of storing sensitive payment information, which is processed exclusively by Paddle;
- industry-standard security practices for deployed environments and code integrity.
Despite these measures, no online service or method of electronic transmission is completely secure. You acknowledge that absolute security cannot be guaranteed, and you use the Services at your own risk.
You are responsible for maintaining the confidentiality of your authentication credentials and ensuring the security of any accounts you connect to HartLab. We recommend using strong, unique passwords and enabling security features offered by your authentication provider.
3. Refund Policy
HartLab products are digital and may be delivered or activated immediately upon purchase. As our payment and subscription processing is handled by Paddle, HartLab follows Paddle’s Buyer Protection Terms, which include a minimum 14-day refund window for eligible purchases.
Refund requests may be submitted directly to HartLab at official.hartlab@gmail.com , or processed through Paddle’s customer support. All refunds are ultimately handled and issued by Paddle, our Merchant of Record.
Refunds may be granted when one or more of the following conditions apply:
- a critical technical issue prevents normal use of the product and cannot be resolved;
- the product does not function as described and troubleshooting attempts are unsuccessful;
- the request is submitted within 14 days of purchase, in accordance with Paddle’s refund policy;
- there has been no misuse, abuse, policy violation or fraudulent activity.
All approved refunds are processed by Paddle and returned to the original payment method whenever possible. HartLab does not issue refunds directly and cannot override decisions made by Paddle regarding refund eligibility.
4. DMCA & Copyright
HartLab respects the intellectual property rights of creators and rights holders. If you believe that content hosted or displayed through our Services infringes your copyright, you may submit a formal notice to our designated contact.
To be valid, your notice must include all required information under applicable copyright laws (including the DMCA, where relevant):
- your full legal name, physical address and reliable contact information;
- a clear identification of the copyrighted work you believe has been infringed;
- the exact URL or location of the material you claim is infringing;
- a statement that you have a good-faith belief that the use is not authorized by the rights holder, its agent or the law;
- a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf;
- your electronic or physical signature.
Notices can be submitted to: official.hartlab@gmail.com .
HartLab may remove or disable access to material in response to a valid notice. We reserve the right to reject incomplete, abusive or fraudulent notices. Submitting false DMCA claims is illegal and may result in liability for damages, legal costs and other penalties.
If you believe material was removed in error, you may submit a counter-notification with the same level of detail required for the original notice. Upon receiving a valid counter-notification, HartLab may restore the material unless the rights holder initiates legal action within the time period specified by applicable law.
5. Your Data Rights (GDPR / LGPD / CCPA)
Depending on your country or region, you may have specific rights regarding your personal data under privacy laws such as the GDPR (EU/EEA), LGPD (Brazil) or CCPA/CPRA (California). These rights apply only where such laws are legally applicable.
- Access: request a copy of the personal data we hold about you.
- Correction: request updates to inaccurate or incomplete information.
- Deletion: request the removal of your personal data, subject to legal and contractual exceptions.
- Restriction: request limits on how we process certain data.
- Objection: object to specific types of processing where legally permitted.
- Portability: request your data in a portable, structured format.
- Withdraw consent: withdraw consent at any time when processing is based on your consent.
- Non-discrimination: HartLab will not deny services or apply different prices because you exercised a privacy right (as required by law).
To exercise any of these rights, contact: official.hartlab@gmail.com . We may require identity verification to ensure the security of your account and prevent unauthorized requests.
Requests will be processed within the time frame required by applicable law. In certain cases, we may deny requests where we are legally required to retain data (such as for fraud prevention, billing, tax documentation or dispute resolution).
6. General Provisions
6.1. Governing Law
These Terms are governed exclusively by the laws of Brazil, without regard to principles of conflict of laws. You agree that any dispute, claim or controversy arising out of or relating to these Terms or your use of the Services shall be resolved in the competent courts located in Brazil, unless otherwise required by applicable law.
6.2. Dispute Resolution
Before initiating legal action, you agree to first attempt to resolve any dispute informally by contacting HartLab at official.hartlab@gmail.com . HartLab will make reasonable efforts to resolve disputes in good faith.
Nothing in this section prevents either party from seeking injunctive relief for urgent matters such as unauthorized access, misuse, or infringement of intellectual property rights.
6.3. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
6.4. Entire Agreement
These Terms, together with the Privacy Policy, Refund Policy, and any product-specific documentation or additional terms provided by HartLab, constitute the entire agreement between you and HartLab regarding your use of the Services. No other communications, representations or agreements, whether oral or written, modify or supersede these Terms.
6.5. No Waiver
HartLab’s failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Any waiver must be explicit and in writing to be considered valid.
